Terms of Service

By accessing or using TopLinQ (available at toplinq.io), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our platform.

These Terms apply to all visitors, users, and others who access or use the service. By creating an account or using any feature of TopLinQ, you confirm that you are at least 18 years old and have the legal authority to enter into this agreement.

TopLinQ is an AI-powered SEO platform that provides:

• Automated SEO analysis and auditing of your website
• AI-generated SEO-optimized content and articles
• Keyword rank tracking and performance monitoring
• Integration with third-party platforms including WordPress, Shopify, Webflow, and Google Analytics
• Technical SEO recommendations and reporting

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

To access certain features, you must register for an account. When registering, you agree to:

• Provide accurate and complete information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account at support@toplinq.io
• Accept responsibility for all activity that occurs under your account

You may not share your account credentials with others or create accounts for the purpose of circumventing usage limits.

Free Tier: TopLinQ offers free SEO reports without requiring an account. Free reports are limited to 3 reports per email address per month. Free tier usage is subject to change at our discretion.

Growth Plan: Our paid Growth plan is available at $249/month and includes full platform access, unlimited reports, AI content generation, rank tracking, and platform integrations.

Free Trial: New Growth plan subscribers receive a 3-day free trial. You will not be charged if you cancel your subscription before the trial period ends. After 3 days, your subscription will automatically convert to a paid monthly plan.

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize TopLinQ to charge your payment method on a recurring monthly basis.

Auto-Renewal: Your subscription will automatically renew each month unless you cancel. Renewal charges occur at the start of each billing cycle.

Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, your access to paid features will continue until the end of your current billing period. No further charges will be made after cancellation.

We reserve the right to change pricing with 30 days notice via email.

3-Day Free Trial: You will not be charged during your trial period. Cancellation before the trial ends results in no charge whatsoever.

After Trial: Once your trial converts to a paid subscription, charges are non-refundable for partial months. We do not offer prorated refunds for unused time within a billing period.

Disputes: If you believe you were charged in error, please contact us at support@toplinq.io within 30 days of the charge. We will review all disputes in good faith and resolve them fairly.

You agree not to use TopLinQ to:

• Send unsolicited emails or spam using content generated by our platform
• Scrape, copy, or reproduce any part of the TopLinQ platform or its outputs for competing services
• Misrepresent your identity, your website, or your affiliation with any entity
• Engage in any illegal activity, including violating intellectual property laws or privacy regulations
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use automated bots or scripts to abuse the free tier limits

Violation of these policies may result in immediate account termination without refund.

TopLinQ offers integrations with third-party platforms including WordPress, Shopify, Webflow, and Google Analytics. By connecting these accounts, you grant TopLinQ permission to:

• Read and analyze your website content and structure
• Publish AI-generated content to your connected platforms (with your approval)
• Access Google Analytics data to track SEO performance

You may revoke these permissions at any time through your account settings or through the respective third-party platform. TopLinQ is not responsible for any issues arising from third-party platforms, their downtime, or changes to their APIs.

Articles, recommendations, and other content produced by TopLinQ are generated using artificial intelligence. You acknowledge and agree that:

• AI-generated content may contain inaccuracies or errors
• You are responsible for reviewing all AI-generated content before publishing it to your website
• TopLinQ does not guarantee specific search engine rankings or traffic results
• SEO results depend on many factors outside our control, including search engine algorithm changes

You own all content you publish using our platform. By using our service, you accept full responsibility for the content published under your accounts.

TopLinQ's Property: The TopLinQ platform, including its software, design, algorithms, brand, and documentation, is owned by TopLinQ and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform.

Your Property: You retain full ownership of your data, website content, and any content you create or publish using our service. We do not claim ownership over your data.

License: By using TopLinQ, you grant us a limited, non-exclusive license to process and analyze your data solely for the purpose of providing you with the service.

The TopLinQ service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, TopLinQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the service.

TopLinQ's total cumulative liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid to TopLinQ in the three (3) months immediately preceding the claim.

Either party may terminate the relationship at any time:

• By you: Cancel your subscription through account settings or contact support@toplinq.io
• By us: We may suspend or terminate your account for violations of these Terms, non-payment, or at our discretion with reasonable notice

Upon termination, your access to the platform will cease at the end of your current billing period. Your data will be retained for 30 days following account termination, after which it will be permanently deleted. You may request an export of your data during this 30-day window.

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. When we make material changes, we will:

• Notify you via email at least 14 days before the changes take effect
• Update the "Last updated" date at the top of this page

Your continued use of TopLinQ after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you should cancel your subscription before they take effect.

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of TopLinQ shall be resolved in the state or federal courts located in Oregon. You consent to the personal jurisdiction of such courts.
